Ram Baran Yadav Is Not An Executive President

Ram Baran Yadav is like the president of India and the queen of England. The president of India does not call an all party meeting to seek consensus. The queen of England does not call parties for a meeting. It is for the Prime Minister and the president of the major parties to call political meetings.

The constituent assembly is no more because it finished its four year term. The Supreme Court had made it clear the assembly can not last more than four years. Baburam Bhattarai did not dissolve the assembly.

The only legitimate way to give the country a constitution is through a constituent assembly and the only way to get a new constituent assembly is through elections to a new one.

So the best thing Ram Baran Yadav can do to help the process is by cooperating with the Prime Minister to make all legal and constitutional adjustments necessary to hold elections to a new assembly. That is the only way.

The constituent assembly can not be revived any more than King Birendra can be brought back to life by those who might wish to revive monarchy in the country.

The idea of changing Prime Ministers is the most idiotic of all ideas being floated right now. If an all party government is to be formed that necessarily has to be led by the party that was the largest in the last assembly.

You don't change Prime Ministers. You keep this Prime Minister and you induct some members of the Congress and the UML into the current cabinet.

April 2013 would be a good time to hold elections to a new constituent assembly. After that assembly has given the country a new constitution it can then be turned into a parliament through a political decision. And then the country can go on to hold direct elections for an executive president who must earn at least 50% of the votes cast or face a second round between the two top candidates. Then hold state and local elections.

Three Parties: Congress, Communist, Sadbhavana

I think it will be great if the two Congress factions will unite and become one political party. Looks like it is about to happen. That unified party will still have some major work to do in terms of inner party democracy and social inclusion.

Girija Koirala has a huge stature. He is the only head of state on the planet today who has met Mahatma Gandhi in person. I was once detained in Kentucky for 35 hours and there was a TV set inside the large room I shared with about a dozen inmates. I will never known what it means to have spent 10 years in jail. Good for me.

The April Revolution is the first I ever participated in. This was Girija's final.

This unification will make possible a smooth transition of leadership to the next generation inside the Congress.

Such a unification will put an enormous pressure on all the communist parties in the country to become one, and if they do, that will be great. I hope they do. Complete arms management and a total transformation of the Maoists from a parallel state to a political party - no militia, no extortions - will make such a unification possible. The ball is really in the Maoists' court.

The reasons for the two Congress factions to become one are largely national, but the reasons for all communist parties in Nepal to become one are global. Nepal is about to become a democracy of state funded parties. Lenin or Mao could not have thought of a more classless democracy. This will make Nepal the number one democracy on the planet. That is huge, and has immediate implications. The Maoists in India are going to shift from guns and violence to taking a stand that India also become a democracy of state funded parties. Becoming a democracy of state funded parties is the true cure to India's number one security threat: the Maoist insurgency. China is also going to come under a huge pressure to transform itself into a federal democracy of many state funded parties where the Chinese Communist Party is still overwhelmingly the largest. And you are going to see all the communist parties in India, including their Maoists, become one.

I am not a communist. The label I wear is that of a progressive. But when I do my math, I am looking at a possible scenario where the Nepal Communist Party is the largest party in Nepal, and the Chinese Communist Party is not only the largest party in China, it perhaps occupies 80% of the political space to start with, and the Communist Party Of India is the largest party in India.

This looks like a communist revival to me. And I am not worried. As long as multi-party democracy and the Universal Declaration Of Human Rights are kept sacrosanct, the idea of state funded parties and elections are what the progressives in America fantasize about.

So this communist transformation and resurgence is not going to be bad news for the anti-communists, the non-communists, except to the ideological kind, the inconsolable hawks, and they don't matter. The non-communists will always have the option to try and beat the communists at the polling booth. And that healthy competition will be good for the masses.

That leaves out the third camp in Nepal. Just like the Madhesi Kranti has been more complicated than the April Revolution, it is easier to unify the two Congress factions, and create a single communist party in Nepal, than it is to try and organize the third front, and that third front I would like to call the social justice front. That third front is my natural home, so I have to put in the work.

The first step would be to get all the people talking to each other. You show up without any preconditions. The only precondition is that you are willing to engage in dialogue.

The second step would be to decide to see there is space for a political party that will try to turn the playing field level for the traditionally marginalized, the Madhesi, the Janajati, the Mahila, the Dalit.

What do you call that party? I would propose we call it the Nepal Sadbhavana Party. That way you start with already having a name, the party is already registered and established, that will also give an excuse to unify the two Sadbhavana factions. Heck, Badri Mandal - the Mandale - got kicked out of the other Sadbhavana a long time ago. And if Badri Mandal was Gyanendra's Deputy Prime Minister, heck Deuba was Gyanendra's Prime Minister, but looks to me like Deuba is about to become the leader of the unified Congress. Let bygones be bygones.

So you decide to settle on the name Nepal Sadbhavana Party. The good thing for groups like the MPRF, NEFIN, and the Dalit Mahasangh will be that since you did not make a fuss about the name, you get to make a fuss about other things, like who will be the leaders, what will the central committee of the unfied party look like, things like that.

Who will be the leader? The Sadbhavana got the name. So it is only fair Upendra Yadav becomes the party president. General Secretary: Hridayesh Tripathy who gets to continue as Minister. Vice President: Om Gurung/Pasang Sherpa. Vice President: Dalit Mahasangh person. Vice President: Sarita Giri.

Central Committee: 40% Madhesi, 40% Janajati, 20% Dalit, 1/3rd women in each category. Or it could be 35% Madhesi, 35% Janajati, and 10% also Khas, if you can find any Khas. But don't try too hard.

Then you go for the agenda. The MPRF, NEFIN, the Dalit Mahasangh and the others have coalesced around a three point agenda: (1) Home Minister resign, (2) Form probe commission, and (3) Proportional elections to the constituent assembly. The Sadbhavana is not against any of this, but it is not standing by it. So how do you work things out and end up with a common agenda? There has to be some give and take.

Hridayesh Tripathy should work on Girija Koirala. Get the Home Minister to resign right away, get any other Congress person of your choice to become Home Minister, and if you like Krishna Sitaula so much make him Defense Minister in the next, interim government. Also form a probe commission. That is a no brainer, that has to be done. And if Hridayesh Tripathy can not get Girija Koirala to come around to this, the Sadbhavana would walk out of the eight party coalition.

As for the third agenda item, that is tricky. We can try and get parties like the UML and the RPP to come along with us. But we have to be open to a few different options. I don't want to get too specific. Let the leaders discuss, explore, and decide.

But our goal has to be to go into the June elections full force. All agenda items that we can not get the Congress and the communists to agree to now, we use those against them when we go to the people. We turn them into election issues. That should be to our electoral advantage. To expect the Bahuns to do it all for us is mental slavery. We should go into power ourselves, and we have to do it ourselves.

So basically the unified Sadbhavana will halt all protest programs, try and stay in power, try and get the other parties to come along on the three agenda items, but failing to do so, it turns them into election issues and goes to face the electorate full steam. In short, our total focus shifts to the Mahasangram of the elections to the constituent assembly.

Krishna Sitaula's Resignation: Why It Is Important

The Nepal Sarkar has not declared as martyrs all those who died during the course of the Madhesi Movement. The Pahadi Bahuns in power have not called the Madhesi Movement by its proper name to date. They talk of the unrest in the Terai, they talk of the violent protests, they do not refer to it as the Madhesi Movement.

They to this day have not given credit for the Madhesi Movement to the ordinary Madhesis who came out in all towns and all villages. They keep saying the royalists from Kathmandu and the Hindu supremacists from India were behind it. Madhesis are cowards. How could it have been possible for them to organize a mass movement for equality? That is their thinking.

They unleashed state terror upon the Madhesi Movement. They never formally apologized. The only formal apology would be the Home Minister's resignation. That is basic to the democratic form of government. The Home Minister shows no sign of going. Girija Koirala is the real culprit behind this major show of disrespect to the Madhesi Movement.

Krishna Sitaula's resignation is being opposed saying he played a key role in the peace process with the Maoists. That might have been true, but the state terror unleashed upon the Madhesi Movement is the reason his resignation is being demanded. His role in the peace process is not relevant.

And it is not possible there are no third generation Congress leaders capable of filling in. The obvious name is Aftab Alam. But maybe he is too much of a Madhesi for the Pahadi Bahuns who run the Congress party.

The basic show of disrespect towards the Madhesi martyrs by the Pahadi Bahuns continues. That is what Girija's intransigence on this question is about. And they should be made to pay at the ballot box.

And the Pahadi Bahuns in power have consistently maligned Upendra Yadav and the Madhesi Janadhikar Forum. They want to now say they already took care of all the Madhesi grievances, and all the credit for that good work goes to the Pahadi Bahuns in power.

This is a chess game we are dealing with. And we have to beat them at it. All this goes on to show royal dictatorship is easier to tackle. You can see things in black and white. Bahunbaad is a lot of grey zone. But it can be tackled.

One option is to go back onto the streets in huge numbers. For that a strong Madhesi-Janajati alliance would be necessary. And it would only conclude with a fundamental restructuring of the interim parliament and the interim government.

But I am beginning to think the better option might be for the Madhesi-Janajati to make use of the constituent assembly elections instead. I am not discounting the first option altogether. But I am also cultivating the second.

If the Pahadi Bahuns are not listening to our genuine demands, if they are being disrespectful of the martyrs of the Madhesi Movement, it should be easier for us to make our case to the people. And we should perhaps do it.

There is a strong need for a political party that would be the Janajati version of the Sadbhavana. And there is a strong need for a Madhesi Alliance.

The best option would be for the big parties themselves to take up the agenda of the Madhesi, and the Janajati, but they show no signs of doing it. If all the parties were to come up with a map for a federal Nepal that includes a Madhesh state, and that gives clear powers to such a state, that would soothe many nerves, but I think the Pahadi Bahuns keep talking of federalism like it were disintegration.

Federalism is a heightened form of democracy, it is not disintegration. Democracy is the answer to the ageold Madhesi and Janajati grievances.

We will get a Madhesh state, through a movement, or through the ballot box. Either way, we will get it. We will get it both ways. It is not either or. We will get it if the Janajatis come along, we will get it if the Janajatis do not come along. We will get it regardless. No Pahadi Bahun opposition will prevent the realization of a Madhesh state. There will be hell to pay at the ballot box for all those who might not come out in clear support of the Madhesh state. The people have awakened. There is no going back.

Krishna Sitaula Not Going Risks Everything

The ridiculous argument being made on behalf of the Home Minister is that the focus has to be on the political issues raised by the Madhesi Movement, and not on one individual. That is highly ludicrous.

A minister's resignation in a democracy is a very done thing. Ministers resign on much smaller matters. This has not been a mere scandal. There has been a brutal suppression of a major movement. Krishna Sitaula killed more people than Kamal Thapa did.

Krishna Sitaula has to go. I don't care if he resigns on his own, or he gets fired by the Prime Minister. Either way he has to go.

There is a huge political reason for Sitaula to go. If he does not go, that will see more street protests. We could be risking the peace process, we could be risking the constituent assembly.

It is ridiculous of the Nepali Congress to suggest the party can not find another person to become Home Minister. I have been pushing the Aftab Alam name. A Madhesi name would be a smart move on the part of the party only a few months before the elections.

But then Girija likes to play the game of brinkmanship. He likes to push people, he likes to corner people.

If there is another showdown, you are looking at more than the Madhesi taking to the streets. There are a lot of aroused groups now. The Madhesi Movement has given them confidence. Their grievances are just. It is just that it will be wise for this eight party government to get all those groups to come for talks and take their agenda to the constituent assembly.

I think all the various groups just want to make sure the constituent assembly ends up looking like Nepal in terms of its ethnic and gender composition. The challenge is how do you achieve that best without compromising the basic one person, one vote democracy?

I have consistently pushed for reserved constituencies.

I just hope there are no more major street agitations. I hope talks and compromises and concessions carry the day. I hope creative solutions can be found.

It all starts with Krishna Sitaula's resignation.

Too many people died. Too many got hurt. And the Madhesi Movement was but the second chapter of the April Revolution itself.

Go, Krishna Sitaula, go.

This Maghe Kranti has lasted longer than the April Revolution. This Maghe Kranti has produced more martyrs than the April Revolution.

The April Revolution got rid of an entire regime. The Maghe Kranti is not asking for the ouster of the entire government. A Home Minister is a small price to pay. But if the Maghe Kranti goes on for longer, Girija himself will have to go.

Krishna Sitaula has to go on moral grounds. Krishna Sitaula as Home Minister has to take moral responsibility for the police brutality, for the shoot to kill orders. Crowd control does not mean you can shoot to kill. You can only shoot below the waist. But heads have been targeted. That is how most people died.

Everybody who is in power today is in power because of the April Revolution. Of all people, these people in power should understand why the Madhesi are defying curfews. Defying curfews was the trademark of the April Revolution itself.

These seven Pahadi parties are digging their political graves in the Madhesh. The more they postpone the obvious resolution, the more they hurt themselves.

These Pahadis in power are not democratic politicians competing for Madhesi votes and aspirations. These are prejudiced Pahadis who want the Madhesis to know their place in the scheme of things. They have colonial mindsets. They are fast losing relevancy in the Madhesh.

Krishna Sitaula's ouster is the very first thing. Without that the political solution to the movement does not even start.

In a parliamentary democracy, a minister resigns on moral grounds for much smaller things. This Maghe Kranti has been too big. Krishna Sitaula's resignation is about cultivating the proper political culture in Nepal's new democracy.

Party Unification, And One Person One Vote Principle



There should be a parliamentary constituency for every 100,000 people, and there should be a wada for every 1,000 people, so you end up with 100 wada chiefs in each constituency. I think we have to thus firmly establish the one person, one vote principle. We have to stick to it through its vertical implications. If you don't do this you shortchange the Terai. And, more importantly, you shortchange democracy.

The basic organizational principle would be the same. It would be the vertical implications of one person, one vote. And the country would have a left of center party, and a right of center party. The communists seem more likely to do it. And if they manage to do it, and the other parties stay separate, you are looking at that communist party winning 60% of the votes in the country, at least. As long as the communists stay nonviolent, and as long as they stick to the multi-party framework, as no doubt they will, all the glory to them.

This is less like party unification, and more like saying let's dissolve all parties, and let's form a new one from scratch. The party gets established at a national convention. Everybody starts by signing up as an ordinary member. And then you hold elections at all levels to fill up all the posts.

I wonder who would emerge the Chairperson of such a unified communist party. It is obviously between Madhav Nepal and Prachanda. It will be nice to know who has a larger mass base.

These communists should not make the mistake of unifying the parties through unification talks alone. Unification talks are but a starting point. But the actual unification has to take place through a convention.

It amazes me how lethargic Girija has been on this whole issue. But then that is the beauty of democracy. If the Congress does not take similar unification steps, it will pay dearly at the polls.

The implications of there being one communist party are mind boggling. I have talked about its continental implications before. What Prachanda could never have achieved through the gun he is about to achieve through peaceful means beyond his wildest dreams. This is both exciting and interesting.

जनकपुर बमकाण्ड र लोकतान्त्रिक संस्कृति नेपाली कांग्रेसका नेता सुवर्ण्र्ाामशेरको आह्वानमा स्थानीय नेतास“गस“गै हामी पनि प्रहरी चौकी जलाउने, बन्दुक खोस्ने, भन्सार कार्यालय जलाउने र पुलहरू भत्काउने कार्यमा सहभागी भयौं । हामी राति-राति पार्टर्ीीे काममा जान्थ्यौं र दिउसो स्कुलमा पढ्थ्यौं ।........ ०१८ साल माघ ७ गते युवानेता रामचन्द्र सिंह -गाउ“ डाम्सी, जिल्ला महोत्तरी ...... भोलिपल्ट बिहान रामचन्द्र सिंहले बम थम्ााउ“दै मलाई भने, यसलाई जतनस“ग लैजाऊ । मैले हुन्छ भन्दै बम लिई हि“डे“ । सा“झपख रामनारायणबाबुको उमगाव“ -भारत) को कचहरीमा रहेको नेपाली कांग्रेस कार्यालयमा बमहरू बुझाए“ । रातिको खाना खाइसकेपछि स्थानीय नेता र क्रान्तिकारी विद्यार्थीहरूको संयुक्त बैठक बस्यो । हामीलाई जानकारी गराइयो, राजा महेन्द्र भोलि माघ ९ गते जनकपुर आउ“दैछ, ऊमाथि प्रथम जनकपुर एयरपोर्टमा बम प्रहार गर्ने । त्यहा“ असफल भए जानकी मन्दिरमा अर्को प्रहार गर्ने । यस योजनामा को-को जाने आ-आफ्नो नाउ“ भन्नुहोस् भनियो । ......... तर म ०१८ साल माघ ९ गते बिहान एयरपोर्टमा गिरफ्तार भए“ । दर्ुगानन्द झाले नेपाल पसेपछि आफैं गिरफ्तारी दिए । म र दर्ुगानन्द झासहित दलसिंह थापा र दुःखा साहनीलाई सेन्ट्रल जेलको गोलघरको 'सेलमा' फलामे नेल, गलफन्दी, हत्कडीसहित अठार महिना राखियो । ०२० साल माघ १५ गते राति १२ बजेतिर क्रूर र बर्बरतापर्ूण्ा तरिकाले जेलको कारखाना नजिकको कमलको रूखमा झुन्ड्याएर यातना दिइयो । त्यसपश्चात त्यसै रूखमा बा“धी दर्ुगानन्द झालाई गोली ठोकी हत्या गरियो । ......... अरविन्दकुमार ठाकुर
वाम एकता एमाले केन्द्रीय कमिटीको तेह्रौँ बैठकले नेपालमा कम्युनिष्ट आन्दोलन एकीकृत बन्न नसकेको विश्लेषण गर्दै 'एकीकृत र सुदृढ कम्युनिष्ट आन्दोलनको निर्माण गर्न र आर्थिक, सामाजिक र सांस्कृतिक समस्याहरूको समाधान गर्न कम्युनिष्ट पार्टीहरूबीच एकता आवश्यक' भएको ठहर गर्‍यो । ....... अब एमाले माओवादी होइन, समग्र नेपाल कम्युनिष्ट पार्टी बनाउनुपर्छ । त्यसका लागि एमालेसँग एकताको प्रस्ताव राखेका छौँ ....... "अब नेपालमा एउटा कम्युनिष्ट पार्टी भए पुग्छ ।" ........ एमालेले पार्टी एकीकरणका लागि माक्र्सवाद, लेनिनवादलाई मार्गदर्शक सिद्धान्त तथा समाजवाद र साम्यवादलाई अधिकतम कार्यक्रम मान्नुका साथै बहुदलीय प्रतिस्पर्धा, कानूनी राज, मानव अधिकार, मौलिक अधिकार, संविधानको सर्वाेच्चतालगायत आधुनिक प्रजातान्त्रिक मान्यता अनुरूपको जनवादजस् ता आधारहरू अघि सारेको छ । ......... एमालेले लोकतान्त्रिक गणतन्त्र पक्षधरहरूबीच मोर्चा र वामपन्थी दलहरूबीच एकीकरणका लागि स्थायी कमिटी सदस्य वामदेव गौतम, ईश्वर पोखरेल र विष्णु पौडेल रहेको तीन सदस् यीय वार्ता टोलीसमेत गठन गरेको छ । ....... "राजनीतिक दलहरूको ध्यान अन्तरमि संविधान, अन्तरमि संसद् र अन्तरमि सरकारमा गएको छ," पौडेल भन्छन्, "त्यसपछि चाहिँ वाम एकताका साथै मोर्चा गठनको कार्य अघि बढ्ला ।" .......... बृहत् वाम एकताभन्दा पनि ठूला वामपन्थी दलहरूतिर आकषिर्त हुने क्रममा साना वामपन्थी दलहरूबीच भने अझ बढी विभाजन हुनेछ, एमाले र माओवादी दुई ठूला वाम पार्टीसँग नजिकिने क्रममा । .......... त्यसो त अहिले पनि जनमोर्चाका चित्रबहादुर आले समूहले एमालेसँग एकीकरणको प्रक्रिया अघि बढाइरहेको छ भने मोहनविक्रम सिंहले नेतृत्व गरेको चित्रबहादुर केसी समूह पनि एमाले निकट छ । त्यस् तै प्रकाशले अगुवाइ गररिहेको अमिक शेरचनको अर्काे जनमोर्चा समूहचाहिँ माओवादी निकट छ । वाममोर्चाभित्रका तीन वाम घटक पनि गुटगत रूपमा कुनै एमाले निकट र कुनै माओवादी निकट देखिएका छन् । "अहिले सबै पार्टीहरूले ध्रुवीकरणको आवश्यकता महसुस गरेका छन्," माओवादी नेता शर्मा भन्छन्, "तर, त्यो एकता सहज छैन ।"




A videotape of the incidents in Nepalganj on 26 December in the possession of Jana Aastha shows police involved in the violence. They are seen destroying shops and throwing furniture onto fires. In the clash between pahadis and madhesis, the Nepal Police is seen siding with pahadis and firing at madhesis. People in green jackets are visible, provoking the crowd, and mandaleys who work with Kamal Thapa and Rabindranath Sharma are also amongst those involved in the violence. The audio track of videotape contains sections of the crowd saying “Nepal Police jindabad.”

The police recorded are in half uniform and their faces are covered. One heard the words: “This shop is a Nepali’s, don’t destroy it.” The groups systematically attacked shops and homes, and SSP Rajendra Singh Bhandari insulted madhesi protestors, telling them to “go to India to protest”.
