श्रीमान् ,

हम, नेपाल अधीनस्थ तराई(मधेश) के मूल निवासियों के सच्चे प्रतिनिधि और तराई(मधेश) में जारी मुक्ति आन्दोलन के नेता के रुप में आपको भारत–नेपाल “शान्ति एवं मैत्री” सन्धि – १९५० की धारा – ८ का नेपाल में दोहरा मापदण्ड के सन्दर्भ में अवगत कराना अपना कत्र्तव्य समझतें हैं और आपका ध्यान इस ओर आकृष्ट करना चाहते हैं कि नेपालियों(पहाडियों) द्वारा भारतीय भू–भाग को सम्मिलित दिखाकर “वृहत्तर(गे्रटर) नेपाल” के एकतरफा अभियान से अन्तर्राष्ट्रीय समुदाय को गुमराह किया जा रहा हैं और तराई(मधेश) को औपनिवेशिक उत्पीडन में ही रखने की हताशापूर्ण कोशिशें की जा रही हैं ।

इतिहास की नींव पर ही वत्र्तमान का निर्माण होता है । इतिहास का संबंध सिर्पm अतीत से नहीं हैं, उसका संबंध वत्र्तमान और भविष्य से भी है । नेपाल के पाठ्यक्रम और अकादमिक चर्चा के रूप में इतिहास की विषयवस्तुओं के अनुसार नेपाल अधीनस्थ मेची नदी से महाकाली नदी तक का ‘तराई(मधेश)’ किसी शाहवंशी राजा, महाराजा वा नेपाली(पहाडी)का विजित भू–भाग नहीं रहा बल्कि ब्रिटिश स्वार्थ को पूरा करने के सहयोग के बदले नेपाल को हस्तान्तरित किया गया भू–भाग है ।

अतः भारत–नेपाल ‘संधि–१९५०’ की धारा– ८ के आधार पर मेची से लेकर महाकाली तक मधेश के ऊपर रही नेपाली अधीनता पूर्णतः अनाधिकृत और अवैध है । मेची से लेकर महाकाली तक मधेश वस्तुतः स्वतन्त्र भूभाग है । तराई(मधेश) के मूल निवासी(मधेशी) भारत–नेपाल संधि–१९५० की धारा– ८ के अनुसार नेपाल के अधीनस्थ मेची से लेकर महाकाली तक के भू–भाग को ‘स्वतन्त्र तराई(मधेश)’ मानते है जबकि नेपाली(पहाडी) मधेशियों की ऐसी धारणना को नेपाल का विखण्डन मानते हंै ।

दूसरी ओर पहाडियों के अनुसार उसी संधि–१९५० की धारा– ८ के अनुसार भारत के अधीनस्थ तिष्टा नदी से लेकर मेची नदी तक और महाकाली नदी से लेकर सतलज नदी तक का भू–भाग वृहत्तर(गे्रटर) नेपाल का अंग है, मगर ऐसी मान्यता को भारत का विखण्डन नहीं माना जाता है । २९ जून, १९९७ को “वृहत्तर(गे्रटर) नेपाल” के सन्दर्भ में नेपाल के सुप्रसिद्ध इतिहासविद् योगी नरहरिनाथ, अधिवक्ता रामजी विष्ट, अधिवक्ता श्याम प्रसाद ढुंगेल, नेपाली कांगे्रस सुवर्ण के अध्यक्ष प्रह्लाद प्रसाईं हुमागाईं, ‘विशाल नेपाल’ साप्ताहिक के सम्पादक तथा प्रकाशक प्रकाश देवकोटा, राष्ट्रीय जनजागरण पार्टी के अध्यक्ष अशोक लाल श्रेष्ठ, स्वतन्त्र पत्रकार राधेश्याम लेकाली आदि ने मंत्रिपरिषद्, मंत्रिपरिषद् सचिवालय, सम्माननीय प्रधान मंत्री, प्रधानमंत्री कार्यालय, परराष्ट्र मंत्री, परराष्ट्र मंत्रायल और साथ ही संसद सचिवालय सिंहदरबार को परिवादी बनाकर सर्वोच्च अदालत काठमाण्डू में एक रिट(याचिका) दायर की जिसका दर्ता नं. ३१९३ है ।

इसी प्रकार १९९९ में प्राध्यापक तथा “नेपाल ः टिस्टादेखि सतलजसम्म” के लेखक फणीन्द्र नेपाल, पूर्वी नेपाल के आदिवासी किरांत समुदाय के यमबहादुर कुलुङ, पत्रकार प्रकाश देवकोटा, समाजसेवी बाल कुमार अर्याल जैसे विभिन्न पेशा में संलग्न व्यक्तियों ने नेपाली जनता का प्रतिनिधित्व करने का दावा करते हुए सामूहिक रूप से नेपाल की सर्वोच्च अदालत काठमाण्डू में “वृहत्तर(गे्रटर) नेपाल” सम्बन्धी दूसरी रिट(याचिका) दायर की । इस रिट(याचिका) का दर्ता नं. ३९४० है और इसमें मंत्रीपरिषद् सचिवालय, सम्माननीय प्रधान मंत्री, प्रधानमंत्री कार्यालय, परराष्ट्र मंत्रायल, भूमि सुधार तथा व्यवस्था मंत्रायल के साथ—साथ रक्षा मंत्रायल सिंहदरबार को भी परिवादी बनाया गया है ।

सर्वोच्च अदालत के माननीय न्यायाधीश हरिप्रसाद शर्मा, दिलीप कुमार पौडेल और खिमराज रेगमी के विशेष इजलास ने नेपाल अधिराज्य का संविधान, १९९०(२०४७) की धारा २३ और ८८ (१) तथा (२) के अनुसार दायर दोनों याचिकाओं को २६ जून, २००३ के अपने फैसले में निरस्त कर दिया । उस फैसले को चुनौती देते हुए निवेदकओं ने सर्वोच्च अदालत के समक्ष पुनरावलोकन के लिए निवेदन नहीं पेश किया ।

गे्रटर नेपाल के उत्साही समर्थक अपने अभियान को व्यापक बनाने के प्रयासों में लगे रहे । उनलोगो ने सर्वसाधारण व्यक्ति से लेकर छोटे–छोटे बालक—बालिकाओं को भी अपने अभियान में आबद्ध करने हेतु ‘ग्रेटर नेपाल सिमानाको खोजीमा’ नामक एक वृत्तचित्र का निर्माण किया । ९ फरवरी, २००८ को नेपाल सरकार के सूचना तथा संचार मन्त्रालय के अन्तर्गत केन्द्रीय चलचित्र जाँच समिति से चलचित्र जाँच प्रमाण–पत्र लेकर वे पूरे नेपाल में इस वृत्तचित्र के प्रदर्शन एवं वितरण में लग गए ।

२०१० में नेपाल के पूर्व प्रधानमंत्री पुष्प कमल दहल ‘प्रचण्ड’ ने भी ‘गे्रटर नेपाल’ के लिए आवाज उठायी । गे्रटर नेपाल के अभियान में एकीकृत नेपाल राष्ट्रीय मोर्चा, नेपाल नेशलिस्ट फ्रन्ट, नेपाल भू–भाग संरक्षण मंच, राष्ट्रीय जागरण पार्टी आदि संगठित रूप से आवद्ध हैं ।

पुस्तक–पुस्तिकाओं, पत्र–पत्रिकाओं, सोशल मीडिया – फेसबुक आदि के माध्यम से अपने अभियान को व्यापक बनाने के प्रयासों में जुटे हैं । २० मई,२०१३ सुबह ९ .२५ बजे झापा जिले के सुमन श्रेष्ठ ने माउन्ट एवरेस्ट के शिखर पर गे्रटर नेपाल का नक्शा फहराया । राजधानी काठमाण्डू के एक समारोह में पहाडियों ने सुमन श्रेष्ठ का अभिनन्दन किया । इस अवसर पर सीमाविद् बुद्धिनारायण श्रेष्ठ ने पर्वतारोही सुमन श्रेष्ठ को माला पहनाया और अवीर लगाया ।

नए संविधान में गे्रटर नेपाल की सीमा और क्षेत्रफल का उल्लेख करने की मांग को लेकर ग्रेटर नेपाल राष्ट्रवादी मोर्चा ने नेपाली नया साल २०७१ बैशाख १ तदानुसार २०१४, अप्रैल १४ से देशव्यापी हस्ताक्षर अभियान चलाया । २० जनवरी, २०१५ को ग्रेटर नेपाल राष्ट्रवादी मोर्चा ने नए संविधान में गे्रटर नेपाल की सीमा और क्षेत्रफल का उल्लेख करने हेतु दबाव बनाने के उद्देश्य से काठमाण्डू के नयाँ बानेश्वर स्थित संविधान सभा भवन के आगे बैनर के साथ प्रदर्शन किया ।

आश्चर्य है कि १९५० की भारत–नेपाल संधि की धारा– ८ के आधार पर गे्रटर नेपाल बनाने के लिए पहाडियों द्वारा संचालित अभियान को संवैधानिक एवं कानूनी करार दिया जाता ह,ै जबकि उसी संधि की धारा– ८ के अनुसार “मुक्त तराई” के लिए मधेशियों द्वारा संगठित अभियान को असंवैधानिक और गैरकानूनी । कहने की जरूरत नही है कि नेपाल में १९५० की शान्ति एवं मैत्री सन्धि की धारा– ८ का बिल्कुल दोहरा मापदण्ड है ।

पूर्व के घटनाक्रम प्रमाणित करते है कि पहाडी शासकों द्वारा बडे सुनियोजित ढग से मधेशियों को मूलभूत नागरिक एंव मानव अधिकारों से वंचित रखा गया है और उनके न्यायपूर्ण आन्दोलन का भीषण नरसंहार कर दमन करने के लिए सभी पहाडी एकजुट रहते हैं ।

संयुक्त राष्ट्र संघ ने अपने प्रतिवेदन में तराई(मधेश) में नेपाली(पहाडी) अद्र्धसैनिक बलों द्वारा मधेशियों को गैरकानूनी रुप से गिरफ्तार कर उनकी नृशंस हत्याओं को सार्वजनिक किया है । सन् २०११ जनवरी ११ को जेनेवा में संयुक्त राष्ट्रसंघीय मानव अधिकार परिषद के विश्वव्यापी आवधिक समीक्षा (यूपीआर) में नेपाल के प्रतिनिधि तत्कालीन उपप्रधान तथा विदेश मन्त्री सुजाता कोइराला से तराईवासियों की गैरन्यायिक हत्याओं और दोषियों पर कारवाई के बारे में प्रश्न किए गए ।

अन्तर्राष्ट्रीय और नेपाल के मानवाधिकारवादी संस्थाओं के अनुसार भविष्य के होनहार लगभग ३०० मधेशी सपूतों की कायरतापूर्ण गैरन्यायिक हत्याए की जा चुकी हैं और यह क्रम जारी है, करीब डेढ हजार लोग गैरकानूनी बन्दी जीवन बिताने के लिए विवश किए गए हैं ।

ताजा स्थिति यह है कि पहाडी शासकों ने गांव—गांव में पहाडी पुलिस की चौकी, कुछ किलोमीटर पर पहाडी अद्र्धसैनिक सशस्त्र बल का कैम्प और जिले–जिले में पहाडी सैनिकों का बैरेक खडा कर मधेश को हिटलर के कैदखाना मे. परिणत कर दिया गया है और मधेशियों के विरोध की हर आवाज को बडी बेरहमी से कुचला जा रहा है ।

हम, आप से विनम्र आग्रह करते हैं कि आप अपने स्वतन्त्र स्रोत से सच्चाइयों का पत्ता लगाएं कि मधेश में नेपाली शासन के प्रति कितना विरोध एवं नफरत हैं । जब से नेपाली शासकों ने तराई मुक्ति आन्दोलन को बन्दूक की ताकत पर कुचलना शुरु किया, तभी से हमने बाध्यतावश प्रतिरोध की कारवाई का नेतृत्व करने की जिम्मेदारी सम्भाली है ।

अतः हम सम्माननीय प्रधानमन्त्री और भारत सरकार से अपील करते हैं कि वे मधेश को नेपाली औपनिवेशिक शासन से मुक्ति दिलाने एवं मधेशियों को स्वयं अपना राजनैतिक भविष्य निर्धारित करने में न्यायपूर्ण सहयोग करें

Talk With Goit For The Same Reason We Talked With Maoists


For a government to decide to hold talks with an armed group is never an easy decision. That is especially true for a democratic government. The feeling is that if any group or section of the population has grievances, they should peacefully organizae and mobilize and they should seek electoral remedies. If you don't like party A, go vote for party B. There is this fear that if you talk to one armed group, other groups might also pick up arms so as to similarly shortcircuit the democratic process. Those fears are legitimate. But we have to stop pretending that these are normal times.

These breakaway Maoist factions are seeking political space, and we have to give it to them. Dialogue should be considered a very happy price to pay for peace. It would have been a major problem if these groups were opposed to the very idea of dialogue, but that happens not to be the case, lucky for us.

The fear is not that if you manage to disarm these groups, others will pick up arms. The fear is the opposite. There are other groups besides the Madhesi that have grievances. They might also get frustrated, impatient.

Why did we talk to the Maoists in the first place? Because we wanted a political and not a military solution. And that has been working beautifully. I just read the list of Maoist names that will go into the interim parliament. The Maoists put the seven parties to shame. Look at how much more representative they are. Looks to me like we are getting more than peace by talking to the Maoists, we are also getting social progress. That is so wonderful.

The trick is to focus on the just political demands and fulfill them. For the Maoists it was the constituent assembly. If the country had not agreed to that basic demand, no amount of talks would have brought them into the mainstream.

Similarly, these JTMM factions have two just demands that nobody can argue against. Heck, those are my demands also.
  1. Issue citizenship certificates to all Madhesis. That figure is closer to 60 lakh than the 33 lakh the Home Minister is suggesting.
  2. The 205 constituencies should be based on equal population.
Well, Goit also has other demands. He wants all of Terai to be one state. You tell him, that he will have to get himself by contesting in the constituent assembly elections. You fulfill the two basic demands, and then ask him to earn the rest at the ballot box.

Terror in Terai: Missing Seriousness the expanding activities of JTMM in Terai who have steadily intensified their violent actions ........ When it started, the Maoist insurgency was thought to be a low-key, confined/localised and unpopular terror-insurgency and most of the subsequent governments tried to deal with it as a law and order problem. ....... His major plank includes separate state for the Madhesis (Terai). ........ Terai bandh affects normal life The JTMM-called the bandh demanding appropriate representation of Madhesi people in all mechanisms of the state and delimitation of election constituencies according to population ratio. It has also demanded that the Terai region be declared “autonomous province”. ....... Vehicular traffic in Southern districts like Bara, Parsa, Rautahat, Saptari, Sarlahi, Dhanusha and Mahottari remains disrupted since early Friday morning while marketplaces and industries have also been closed due to the bandh.

INTERVIEW WITH SARITA GIRI After her involvement in the popular movement of 1990, her association with the Nepali Congress increased. As a result she sincerely got engaged in the activities of the party. But, in 1996 her political career took a turn. ...... She was highly influenced by the Samajwadi Janata Dal, a political party established by the late Gajendra Narayan Singh. She says, “I joined the party after Gajjubabu gave the membership of the party to me.” Later both the Sadbhawana and Samajwadi parties amalgamated into Nepal Sadbhawana Party (Anandidevi) of which Giri is the Central Member at present. She was born in Champaran which is situated on the Nepal-India border and is also known as old Nepal. Later she got married to a Nepali. She was the speaker of her party earlier and also member of the Janaandolan Working Committee. At present she is the chairman of Nepal Bharat Maitree Sangh and the Centre for Women and Politics. ........ The contribution that women have made in making the Janaandolan 2 a success cannot be ignored. ...... it is also my duty to define independence and democracy from a woman’s point of view ....... we must follow the state's policy, which seeks one-third women involvement in every sector. But our ultimate goal is to create a proportionate society. ........ Educated and capable women will definitely get opportunities. But, the very same parties who once hesitated to give women 5% reservation will be compelled to give them a 1/3 reservation. ........ there is no clear roadmap for the restructuring of the state. ....... a prime minister who is not answerable to the Constituent Assembly is no less dangerous than the king in the past days ....... If the Constituent Assembly elections are not held in future, do we lack the right to approach a court? ...... The Terai Congress was formed in 2008 BS. I have just returned from a tour of Terai villages. I also talked with some local JTMM leaders. ........ The Maoist party which approved the five development regions of the "old state" has not given Matrikaji (Maoist leader Matrika Yadav) a respectable place. ........ As long as the people of Terai origin do not have access to the security bodies, this kind of discrimination will continue. ......... The government has also ignored the fact that the electoral constituencies should be based on population. ....... Isn't the betterment of the Terai people good for Nepal as a whole? The government collects 77% of its revenues from the Terai, but only 18% of the development budget is allocated to the region. ......... Sadbhawana has never indulged in racial politics. It is our political religion to take care of the betterment of the entire Terai region.......... Can a woman be asked to give up her citizenship just because she gets married to a person from another country? How can you compare getting married or liking someone to getting a citizenship? What kind of a nationalism is this?
