Girija's House Revival Stand: The Real Reason


It just occurred to me in a flash. I was slowly waking from a nap, and it occurred to me. Girija Koirala's House revival stand that has been the one constant in his life since 2002 is nothing to do with 2002, it is to do with 1960.

When Mahendra murdered the parliament and, with it, democracy in 1960, he did not invoke any constitutional clause, he did not offer any political logic, he did not first invite BP for a dialogue or a debate. He just did it, with brute force.

Girija Koirala wants to get even. He wants the House revived by sheer magic for magical reasons. Forget what is and what is not in the constitution, forget the political reasons for and against, he is saying. Forget all that, forget them all.

There is this scene in the movie Apollo. The astronaut looks down from his space ship through its tiny window towards the earth. At the same time his wife back on earth looks out and up her window. They make this brief eye contact.

BP is looking down at Girija from the sky. Girija is looking up.

Democracy is political logic. But these two Koirala brothers turn democracy into a love equation. I don't think there is another example like them anywhere else in the Global South, the so-called Third World. They stand to inspire every other country that is still deprived of this beautiful thing called democracy. Democracy is the best gift a people can get. Koirala is a brand name, and it is an export item. Billions today are still deprived of democracy on the planet. The democracy message of BP Koirala was cutting edge half a century ago. It is cutting edge today.

Nepal gets to export Buddhism and democracy, both.

My eyes have gone wet with this insight. Girija is refusing to let go of BP. If there is a line between one brother's love for another, and a political career dedicated to democracy, that does not exist between these two Koirala brothers. To them one is the other.

Gyanendra is not Mahendra, but he sure has been trying his best to imitate Mahendra. Gyanendra and Mahendra are the same tendency. The institution of monarchy has to pay for 1960.

It was Deuba who dissolved the House in 2002, it was not Gyanendra, but who cares? A prime minister in a parliamentary democracy retains a right to dissolve the parliament, but who cares?

This is not about dry facts of a certain day, a certain act. This is not about the constitution. This is about history, this is about the ideal of democracy, this is about magic. This is not about vengeance, this is about justice.

Democracy has to be given birth to, once and for all, and Tulsi Giri has to be put on trial, and he has to be put behind bars. When you drive faster than the speed limit, you get a speeding ticket, because speeding is illegal. Murdering democracy has to be wrong and illegal many many times over. Tulsi Giri has to answer for 1960, he has to answer for BP. In a country's history, 45 years is a blink of an eye. 1960 is not that far back in time, or we would never have heard of Tulsi Giri again, but we did. It is Gyanendra's service to the country that he brought Tulsi Giri back. Now Giri does not get to leave. He ends up in jail. He has too much to answer for.

RPP Split Shows Monarchy Will End


Kamal Thapa's claim that he heads the real RPP is flat wrong. On the other hand, he has every right to launch a separate party of his own, perhaps a RKP, after the RPP and the RJP, Rashtriya Kamal Party. This guy transported his cadres from across the country in government helicopters for his convention. That act has got to be wrong in many books at once. That is blatant corruption.

As late as early last year, the monarchy had the option to renew itself through a constituent assembly. 2004 might have been better, and 2003 still better. 2002 would have been even more so. Back then the major parties in the country would have gone to the people seeking a mandate for a constitutional monarchy.

But the king got bored. Maybe he really does not want to be a constitutional monarch. What was he before he became king? A businessman? An advisor to the king? He is more used to not being king than being king. The transition should not be hard.

Or maybe he will join Kamal Thapa's party. It will be within their rights to float parties and contest elections.

The world ends not with a bang, but a whimper, the saying goes.

The recent fierce Maoist attack on Dhanagadhi had me worried. That is one of the largest towns in the country. The army has its regional headquarters there. Obviously the state security forces run poor intelligence operations. They did not see 1,000 armed Maoist cadres when they were maybe 10 miles away, or 30 miles away. And it took them hours to respond. The Maoists did not cost lives. They damaged a few buildings and they left. I am against violence, but if there is going to be violence anyway, I'd rather a few buildings get damaged rather than a few lives get lost.

The Maoist presence is in every district, and they have not weakened. They strike at will, when they want to, where they want to. There is only a political solution to the insurgency. That is truer now than it was ever before, and that was true last year, and the year before, and the year before that.

The RPP was one strong block of support for the king. Now even that has splintered. It is beneath the king to seek support for the monarchy from the people. That is called an attitude problem.

According to the king he is the only one who understands democracy. The seven party leaders don't. The RPP Pashupati Rana does not. If that is the claim, I am not betting on the king. The numbers go against him.

At this point if constituent assembly elections are held, the country will go for a republic. That is a foregone conclusion. So the seven party alliance might as well come around to the simple, clear slogan of a democratic republic. Why beat around the bush?

The politics in the country is going through a major flux, that's for sure.

The king is trying his best to look confident for the TV cameras during his visits to the districts. But the fundamentals all point against him. He is in deep trouble. The monarchy looks like on its way out.

The end of the monarchy is no longer an if, but rather a when and how, not even when, just how. I prefer a peaceful transformation from king to citizen. He gets to keep his private property. But that is if he behaves.

I think the king not only does not "get" democracy, he also does not "get" constitutional monarchy. A constitutional monarchy is not involved in politics, and it does not command the army. He does not accept that. His idea of democracy is one where the fundamental rights can be taken away if the king might so wish. And he has an activist monarchy in mind. Prime Ministers might get elected, but they still serve him. That is his idea. That will not fly, that was not going to fly.

It has been beneath him to talk to the parties. Talk about an attitude problem.

The king could have invited Pashupati Rana for talks to explain to him as to why the RPP should contest the February 8 polls, he could have tried to win Rana over, but instead he worked to split Rana's party. The guy does not have the political skills for give and take, it is my way or highway. His basic approach is undemocratic. He wants master-slave relationships. He gives orders, and others follow.

निरंकुशताको अन्त गर्न सात दलद्वारा आयोजित विरोध सभामा जनसागर उर्लिएको देखेर स्वयम आयोजकहरुले जिब्रो काढे। लाखौलाख नागरिकले उत्साहसाथ जनसभामा भाग लिए।

मिथिला क्षेत्रमा भएको विरोध सभामा जनसागर उर्लेको देखेर नेताहरु दंग पर्दै चर्का भाषण गरे। उनीहरुले भनिदिए-अब राजाको शासन समाप्त हुन्छ।

राजाको शासनलाई लम्ब्याउने सोचाई बोकेका दलाल पिछलग्गु तथा चम्चाहरुले विरोध सभालाई बिथोल्न गरेको प्रयासलाई निस्क्रिय पार्न नागरिक सञ्जाल सक्रिय रह्यो। सुरक्षा बेस क्याम्पमा पाँच वटा बसलाई भने सुरक्षाकर्मीले रोकिदिए। भिमवान क्याम्प नजिक बसहरुलाई रोक्दै झण्डा, ब्यानर र तुल खोसियो।

पूर्ण लोकतन्त्र हाम्रो जन्मसिद्ध अधिकार भन्ने नाराका साथ आयोजित विरोध सभामा नेपाली कांग्रेसका सभापति गिरिजाप्रसाद कोइरालाले जनतामाझ चार वटा प्रश्न राखे- ‘तपाईहरु निरंकुशतन्त्रको अन्त चाहनुहुन्छ कि हुन्न - पूर्ण प्रजातन्त्र चाहनुहुन्छ कि हुन्न - शान्ति चाहनु हुन्छ कि हुन्न - र स्वतन्त्रता स्वाभिमान चाहनुहुन्छ कि हुन्न -’

उनको प्रश्न नसकिँदै लोकतन्त्रवादीहरुको जमघटबाट एकै स्वरमा आवाज निक्लियो-चाहन्छौं। कोइरालाले यही उत्तरका साथ सात दल माओवादीसित सहकार्यमा जुटेको जानकारी दिए।

जनकपुरको विरोध सभामा ओर्लेको जनसागर देखेर आफूलाई काठमाण्डौंमा माघ ७ गते हुने विरोध सभाबाट राजतन्त्रको अन्त हुने विश्वास लागेको बताए

‘हामी गणतन्त्रमा जान्छौं कि प्रजातन्त्रमा रहन्छौं’ भन्ने निर्णय गर्ने सम्पूर्ण अधिकार जनतामा रहेको भन्दै कोइरालाले थपे- ‘राजा आफूलाई दैवीशक्ति भन्छन्। तर राजा दैवीशक्ति रहेनन, दरबार हत्याकाण्डसँगै समाप्त भयो

एमालेका महासचिव माधवकुमार नेपालले विशाल सभा देखेर हौसिदै भने-राजतन्त्रको अन्तिम दिनगन्ती सुरु भैसकेको छ। त्यो दिन टाढा छैन। माघ ७ गते जनताले ढाड भाँच्ने छन् र त्यसपछि हामी डाँडा कटाइदिनेछौं।

मधेशीको अधिकार, महिलाको समान अधिकार उत्पिडीत सबैलाई अधिकार पुरानो संविधानले दिन नसकेको उल्लेख गर्दै नेपालले यही कारण नयाँ संविधान आवश्यक भएको बताए।

‘नयाँ संविधानमा क्षेत्रीय भावना, जातिय भावनालाई कदर हुने र छुवाछुत जस्ता समस्या समाप्त हुने’ उनले बताए।

प्रजातान्त्रिक काग्रेसका कार्यवाहक सभापति गोपालमान श्रेष्ठले आफ्नो दलको महाधिवेशनले विधानबाट राजतन्त्र शब्द सर्वसम्मति झिकिदिएको उल्लेख गर्दै निरंकुश राजतन्त्र समाप्त पार्न संविधान सभाका लागि सक्रिय हुन उद्योगी, व्यावसायी तथा किसानसँग आग्रह गरे।

जनमोर्चाका अध्यक्ष अमिक शेरचनले नेपाली जनता अब लोकतन्त्रको दिशामा बढिसकेकाले मुलुकमा गणतन्त्र आउनलाई कसैले छेक्न नसक्ने बताए।

मानव जनसागरअगाडि गोली बारुदका केही काम छैन भन्दै शेरचनले ‘नगर निर्वाचनका उम्मेदवारलाई समर्थन नगरौं, भोट नखसालौं’ भन्ने सन्देश घरघरमा पुर्‍याउन सके निरंकुशता त्यसै थला पर्ने बताए।

नेपाल मजदुर किसान पार्टी अध्यक्ष नारायणमान बिजुक्छेले मुलुकमा प्रजातन्त्र विदेशीको भरमा होइन नेपाली जनताको खुट्टामा उभिएर आइरहेकाले संकिर्ण राष्ट्रवादीले जनताको ध्यान मोडनको लागि नगर निर्वाचनको चालबाजी रचेकाले त्यसको विरोध अनिवार्य बनेको तर्क गरे।

नेसपाका उपाध्यक्ष भरतविमल यादवले राष्ट्रघाती काम जनता र नेताबाट होइन राजाद्वारा हुने गरेको बताए।

वाम मोर्चाका अध्यक्ष नन्दकुमार प्रसाईले लोकतन्त्रको संस्कारलाई बलियो बनाउन नगर निर्वाचनको विरोध गरौं भन्ने आग्रह गरे।

बाह्रविघामा १२ बजे आउन जनतासँग आव्हान गरिएपनि दस बजेदेखि नै भीड सुरु भएको थियो।

सात दलको जनकपुर सभामा दशौं हजार सहभागि

शाही कदमका विरूद्ध आन्दोलनरत सात राजनीतिक दलहरूले जनकपुरको बाह्रविघा मैदानमा एक विशाल विरोध सभा सम्पन्न गरेका छन्।

सात दलका शीर्षस्थ नेताहरूले सम्बोधन गरेका उक्त विरोध सभामा एकलाख भन्दा बढी जनसहभागीता रहेको हाम्रा संवाददाताले बताएका छन्।

सात दलका नेताहरूले तराईमा एउटै मञ्चबाट विरोध सभालाई सम्बोधन गरेका यो पहिलो अवसर हो।

बाह्रविघाका अतिरिक्त नगरको भित्री भागमा पनि मानिसहरूको ठूलो चहलपहल थियो भने विरोधसभा सकिन लाग्दा पनि फाटफुट रुपमा जुलुशहरू आइनै रहेका थिए।

जुलुशमा स्थानिय मानिसहरूका अतिरिक्त सिराह, सप्तरी, सिन्धुली, सर्लाही, उदयपुरसम्मका मानिसहरू आएको बताइएको छ।

विरोधसभालाई सम्वोधन गर्दै नेपाली कांग्रेसका सभापति गिरिजा प्रसाद कोइरालाले राजतन्त्रको भविष्य राजाको भूमिकामा नै निर्भर हुने बताउनुभयो।

नगर निर्वाचनलाई सकृय रुपमा वहिष्कार गर्न आव्हान गर्दै नेकपा एमालेका महासचीब माधवकुमार नेपालले भन्नुभयो, ''पूरानो सम्विधानले काम चल्दैन, अव नयाँ सम्विधानको निर्माण गर्नुपर्छ। त्यसका लागि सम्विधानसभाको निर्वाचनामा जानुपर्छ।''

विरोध सभालाई सात दलका अन्य नेताहरुले पनि सम्वोधन गरेका थिए।

बक्ताहरूले नगर निर्वाचन विथोल्न सकृय भएर लाग्न आव्हान गरेका थिए।

विरोध सभालाई विथोल्न राज्यपक्ष सकृय हुने आशंकामा नगरको विभिन्न प्रवेशमार्गमा एक दर्जन भन्दा बढि मानव अधिकारवादी कार्यकर्ताहरूले अनुगमन गरेका थिए।

कतिपय सहभागीहरूले २०४६ सालको जन आन्दोलनपछिको यो सबभन्दा ठूलो विरोधसभा भएको बताए।

सकृय राजतन्त्रका विरूद्ध आन्दोलनरत सात राजनीतिक दलहरूले जनकपुरमा बिहिबार आयोजना गरेको विरोधसभामा एक लाखभन्दा बढीले भाग लिएको र माघ १९ को शाही कदम यताको सो सबभन्दा ठूलो भेला भएको बताइएको छ।




What We Are Up Against














Yesterday I painted three worst case scenarios:
  1. The king imposes martial law. That would hurt him further, but he could do it as an act of desperation.
  2. The king could get ousted, and the army could stage a coup and take over. Pyar Jung could end up the Nepali Musharraf.
  3. The king could get ousted, the army could get disbanded, and the Maoists could decide they want a communist republic after all, and they want it now. Nepal could end up a one party state of the Maoists.
But I added that I don't see any of them likely.

We are up against the king, and he will do what he has said he will do. He has this thing called a roadmap. He asked for three years in which to hold elections. I don't think there is a secret military crackdown in the offing. I don't think he is on his way to ban political parties. But he is going to be uncompromising with his roadmap.

In his mind he has been adhering to the 1990 constitution.

The parties accuse him of dissolving the parliament in 2002. It was not him, it was Deuba. That is just a fact, kind of like saying Mount Everest is 8,848 metres high.

Then Deuba got dismissed six months later. What were the options? Could Deuba have stayed Prime Minister indefinitely until elections were held, which might have been two or five years from then, or never? I don't think so. Deuba's ouster also I don't question.

Then he invited the formation of an all party government. Why did the parties not take it?

Look at the current roadmap of the seven party alliance. One, revive the House. Two, form an all party government. Three, hold peace talks with the Maoists. Four, hold elections to a constituent assembly. If they had this roadmap right when the king invited the formation of an all party government, they could have taken it, right? Perhaps. But they did not have this roadmap back then. Back then none of the big parties were for a constituent assembly. The Congress and the UML were totally committed to the 1990 constitution.

All this I am saying within the framework of the 1990 constitution. I don't like that document. I fundamentally disagree with it. So none of these apply to me. But they apply to parties that as late as 2004 were for the 1990 constitution.

Political confusion led to constitutional confusion led to chaos.

I start with the facts on the ground. The Universal Declaration of Human Rights is the fundamental law of the planet. Nepal has had the worst human rights violations of any country on the planet on this king's watch. Some people claim Nepal is not a signatory to the International Criminal Court. Do you think Saddam is at the Hague? A country can set up its own tribunal and punish the pepetrators. Saddam is being tried for crimes he committed in the early 1980s.

You look at the physical terror, the killings, the disappearances, you look at the attacks on free speech, free assembly. Journalists get harassed. Party rallies get disrupted.

Do we accept the 1990 constitution? And has the king been acting within the spirit of the 1990 constitution? The answer to both is no.

I have made it clear my disagreement with the House revival idea. But it is for the seven party alliance to decide exactly what route they will take. I intend to support the alliance in all ways I can.

I wonder if the parties will feel safer with a House around. If there is a House of 205, then it becomes harder for the king or the army to try anything funny. Is that the idea?

The reason for House revival can not be constitutional because there is nothing in the 1990 constitution that allows that. The reason can not be political because if the goal is a constituent assembly, you get there faster when you don't revive the House. So it must be safety concerns.

With a House in the picture, the seven parties will feel bolder in comparison to the other political forces in the country. That must be the reasoning.

But the king's attacks keep being political. When parties organize rallies, he organizes a trip to the eastern districts, for the benefit of the TV cameras.

The monarchy must be a strange institution. People react to it in strange ways.

We are up against the king. His primary attacks are going to be political. He is going to stick to his roadmap.

February 8 will be a major turning point. If he can get even 30% of the voters to show up, he can claim a small victory. If nothing else, he buys time. But if all the major parties boycott the polls, then he has already lost. Because this conflict is not constitutional, it is political.

Another reason for House revival might be that the parties that have split secretly hope to reunite, perhaps. That might be easier to do with a revived House.

Yet another reason might be that the democrats want to get even with the king and the Maoists. 2/1 was extremely unreasonable. The Maoist call for a communist republic has been unreasonable. Payback time: the parties are also going to be a little unreasonable. They are going to want the House revived.

A few damaged buildings here and there, a rally here, a rally there: if that were to continue, the king will just stick to his roadmap. I don't think he will budge. Instead he will claim the Maoists are still a menace, and that justifies his histrionics, and look at the rallies, who says there is no democracy!

But if a million people were to gherao the Narayanhiti, he will have few options left. At that point the parties will have the option to negotiate with him, or they could decide to not negotiate at all. At that point things still look a little murky. But I feel that is the direction we are headed in.

My emphasis has been that the movement has to attain clarity before it can achieve a conclusion.

The seven party alliance has it tough. The work they are doing is not easy. Their resources are limited. Much is at stake. They are taking several risks. All democrats have to be supportive. They are our leaders. They are the best we have, and they are good. They are more in tune with the ground realities than anyone in the diaspora. Their political acumen is sharp.

The struggle is political. This is movement time. And the diaspora has to extend all help it can.

The Blame Game


Some people badmouth the political parties endlessly. They blame the parties for the Maoists, they blame the parties for the king. They blame the parties for the 1990s as if that was a dark period in Nepal's history when facts prove otherwise: just look at all the infrastructure work that got done. Dark compared to what? The Panchayat? The Rana rule?

It is one thing to criticize the political parties. After all, it is that right to free speech that we are fighting for when we are fighting for democracy, a right that neither the king nor the Maoists allow. But it is quite another thing to pour your resources into attacking the political parties when those resources should be directed against the autocratic camps in the country.

The political parties did not give birth to the monarchy and its inherent autocratic tendencies. The political parties did not give birth to the ideology called Maoism.

Infighting is a symptom of powerlessness. When we attack the parties, we democrats are engaging in infighting. We have to counter that tendency so as to strengthen our democratic camp.

It is not true the monarchy and the Maoists are stronger than the ideal of democracy. A democracy would be one where the country is lead by someone who is directly elected by the people who is Commander In Chief of the army and is sworn to uphold and protect the constitution. Protecting democracy would be the army's prime responsibility. Attempts to sabotage democracy would amount to treason. Both brute physical force and rule of law would be on democracy's side.

But that democracy we have never had.

It is sad the king did not reciprocate the Maoists' ceasefire. And it is sad the king did not appreciate the 12 point agreement between the Maoists and the political parties. But then it is hard to understand the king's actions if you look at him through the eyes of the democrats. The monarchy is out to preserve itself and expand its base. The country is a small price to pay.

People like Girija Koirala, Madhav Nepal, Sher Bahadur Deuba and the rest have been duly elected by their respective parties. It is one thing to criticize their specific words and actions, but it is quite another to be dismissive of them. Girija is not the reason the king has the country under his claws, the king is the reason.

We should focus more on the future agenda in the democratic camp. If we did not like what the country had in the 1990s, we should work to offer an alternate vision for where the country should go down the line.

But even that is kind of secondary. The immediate challenge is to help the movement for democracy the best we can. Attacking people in the democratic camp is hardly the way to go.

There are three worst case scenarios I see.

I don't see either of these unfolding, really. But we have to watch out. And we have to proactively prevent them. We do that by putting forth a sophisticated, effective, robust democracy movement. We have to act like we are going to reoccupy the center.

My Proposal To The Saturday Symposium At Columbia

I believe this is going to be a fairly representative group of Nepalis from across the continent although I don't believe the Nepali organizations in the US have ever truly been mass based. But this meeting has to be made the best use of if we are in tune with the mass movement in Nepal.

I would like to propose a few concepts and a few projects.

Concepts

(1) We have to become mass based.

If there are 50,000 Nepalis in the US, we have to find ways to reach out to as many of them as possible. The Flickr project is designed to do that. This might be the best, simplest, cheapest, fastest, most egalitarian, most hassle free, most inclusive, most decentralized way to do it. People with digital cameras should reach out to the Nepalis in their respective circles, take group pictures of people who support the cause, upload them at Flickr, and tag them nepaldemocracy.

We have to seek dignity not only for Nepalis who have college and advanced degrees, who hold top paying jobs with institutions of renown, Neplis who are US citizens and green card holders, but also those who only have high school degrees, who work odd jobs, who work below minimum wage. The positive fallouts are many. We are in good position to present Nepal as the Iraq for the Democrats for 2006 and 2008. We could hope to work to earn voting rights for non-citizens in cities like New York: no taxation without representation.

Participation in the democracy movement is not just for those 27 million back in Nepal but also for the 50,000 in the US. See this as political self interest.

(2) We have to think of the Internet as the new country.

It is not America. We don't live in America. America is Europe, the Internet is America. The traditional geographical boundary/barrier between Nepal and America no longer exists if we can fully embrace the Internet. If we were to create a few open, virtual "parliaments," we could contribute not only to the establishment of democracy, but also to the institution building without which democracy is at best hollow, and also to rapid economic growth for the country, year in year out, decade in decade out. There is no substitue to face time, but we have to optimize screen time to the max to both enrich face time, and also to make interaction and exchange possible when face time might not be an option.

Because of the internet, we all can become our own media. (Blogger, Audioblogger, Blastpodcast, YouTube) This is true for those of us in the US but also for those in Nepal. We could truly collaborate with people at the other end and we should do it.

(3) Put your money where your mouth is.

Talk is not enough. Ideas are not enough. Press statements are not enough. Lobbying is not enough. Rallies are not enough. Events are not enough.

We have to move on to that next step, which is to provide major logistical support to the movement back in Nepal. Several projects were identified at the Nepal Democracy Google Group in November. All 50,000 Nepalis in the US can afford to donate at least $10. Many can afford to donate $1000 or more. And we should do it. We can disagree on how that money should be raised and spent - personally I am for the most decentralized ways possible - but we can not disagree on if or not to raise the money. Money has to be raised.

I am for going beyond the projects identified so far to directly funding the protests rallies and programs of the seven party alliance. They should take care of the political aspects, we should take care of the financial aspects. We could quicken the pace of the movement for a quicker resolution. We have the power to do that.
