No schism within FDRA on CA revival‚ say Madhesi leaders

I have come to think CA revival is the best way to move ahead. Revive the CA, don't do constitution work outside the assembly. Schedule debates on the last unsettled issue of federalism. And let there be procedural votes.

Revive the CA now, finish work on the constitution in a month and hold parliamentary elections in May. Hold local elections by the end of 2013.

Then shoot for double digit economic growth rates.

"See, our party is united for reinstatement. Nepali Congress´ establishment is against reinstatement but 80 out of around total 112 former NC lawmakers have signed in favor of CA revival. Sher Bahadurji and Ram Chandraji are for revival," Dahal explained. "Similar is the situation in the UML. A section of the party is rigid against reinstatement but around 65 former lawmakers have lobbied for revival."

He also claimed that even lawyers and judges have lately realized that the Supreme Court´s verdict against CA´s term extension was ill-timed. "Even people in the court have now started to say that they shouldn´t have stood against CA extension had they foreseen present political complexity," he said. "So, lately, people are again realizing the need of the elected body."

3 Point Package Deal


  1. On January 5 a new all party government in the leadership of Sushil Koirala is formed. It includes the NC, the UML, the UCPN(M), the CPN(M), the UDMF, the FDF. The UML gets Home, the UDMF gets Defense, the UCPN(M) gets Finance, the CPN(M) gets Sanchar, the FDF gets the Foreign Ministry. The rest of the ministries are fairly distributed among the six constituent groups. There is a Deputy Prime Minister from the UCPN(M). 
  2. This all party government on January 6 passes on to the president all election related ordinances that the president promptly approves. These details are agreed to before the all party government is formed. There are 240 directly elected MPs, and perhaps 101 elected through the proportional mechanism for a total of 341. 
  3. Elections must be held by the end of May 2013. If elections are not held by then, Sushil Koirala must resign. Such is the agreement.

I am crunching some numbers based on this. And I remember Baidya claiming they are now the third largest party, so I am guessing they have more MPs than does the UML. I don't have the figures for where the Madhesi parties stand after their many splits.

Looks like both the Maoists-Madhesis and the NC-UML need the help of the Baidya group to be able to form a majority government if the assembly is revived. Or if the NC-UML bring a no confidence motion the Baidya group would have to abstain for the Baburam government to survive.

The key thing, though, is the federalists already have the signatures of two thirds of the members of the assembly. Federalism can be secured through the assembly.

Below is a part of a paper I wrote more than a decade ago. It helps understand some of the Nepali Congress behavior right now. The NC and UML Bahuns "experience intense feelings of vitality when they manage to resist change." In their case what they are opposed to is federalism in Nepal.

Bion introduces several concepts, one of which is that of the proto-mental system, “(one) in which physical and mental activity is undifferentiated, and which lies outside the field ordinarily considered profitable for psychological investigation (153).” It is a realm that does not deal with individual or even group psychology but with the dynamics of groups the way chemists deal with the electrons but not the nucleus of the atom, or the cook deals with food but not with the composition of it the way a chemist might. This concept takes group dynamics beyond the realms of studies of individuals as individuals rather than members of groups.

Another concept Bion introduces is that of valency, borrowed from chemistry. It is described as “the capacity of the individual for instantaneous combination with other individuals in an established pattern of behavior (175).” This concept leads credence to the later assertion that individuals start with some primal instincts within them that they seek to fulfill after losing part of their individuality once gaining membership of groups.

The leader of the group plays an important role in sustaining it and is focal to its existence, but it is not true that the group is the invention of the leader, the opposite is. The group creates its leader who or, in the case of an idea being the leader, which sustains it. Some person or idea fills the role already created by the type of group that might happen to be. The freedom of the leader is considerably circumcised as that of the members of the group even though the members instinctively might feel the need to follow the leader. The group ignores the leader that moves beyond the prescribed role or the “basic assumption,” a concept to be dealt with later in the paper. Hence the leader does stand out in that he or she or it is indispensable but is not free. The leadership roles differ depending on the nature of the group.

There are two basic types of groups: the work groups, and the basic assumption groups.

The work groups meets to perform a certain task and focus on certain mental activities rather than the individuals that are its components (143). The work groups tend to rely on rational methods to perform their set tasks. The work groups engage in translating thoughts and feelings into action and behavior that hold some relationship to reality whereas the basic assumption groups permeate feelings and are indifferent to their surrounding reality.

Unlike the basic assumption groups, the work groups place an emphasis on understanding, growth and development. Hence the work groups tend to have organizations and structures whereas the basic assumption groups do without them because they can do without feelings of co-operation. Intellectual activity that might not fit in with the basic assumptions are ignored by the basic assumption groups. The valency of the individuals in the case of the basic assumption groups does what co-operation does for the work groups. The basic assumption groups rely on primal feelings for their sustenance and are not composed to seek development. In fact they experience intense feelings of vitality when they manage to resist change (159).

The work groups recognize time but the basic assumption groups do not. In fact the basic assumption groups feel threatened by any attempt to make it aware of the dimension of time and persecute any such efforts. The basic assumption groups are immune to both development and decay (171). These groups neither disperse nor meet. The experience of impatience for the work groups is translated into a feeling of anxiety on the part of the basic assumption groups.

Verbal exchange is an element associated with the work groups and not with the basic assumption groups. The basic assumption groups do not use language as a vehicle for thought and its use lacks precision and scope. There is a limited use for the formation and use of symbolic communication. The characteristic is tied in with the group's urge to do without development.

It is important for the leader of a work group to maintain contact with reality but the leader of a basic assumption group can do without it.

The basic assumption groups respond "involuntarily, automatically, inevitably" to unexplained impulses and release psychotic anxiety and basically are "emotional states that find an outlet in the mass action of the group in behavior that seems to have coherence if it is considered to be the outcome of a basic assumption (189)." The feelings of anxiety, fear, hate and love are commonly shared by the basic assumption groups.

The basic assumption groups are of three broad types: the dependence groups, the pairing groups and the fight-flight groups. There also are schismatic groups and specialized work groups.

The feelings that hold these groups are guilt and depression in the case of the dependent group, Messianic hope in the case of the pairing group, and anger and hate in the case of the fight-flight group. God or some "past" leader is at the helm of the dependent group. In the case of the pairing group it is the unborn genius or the "future" leader. The fight-flight group accepts for its leader whoever might lead it to run away from or attack an object or group that is hated or feared and can adeptly change to one mode of action from another.

The dependent group relies on its history to provide it with leadership.

Schismatic groups exist when one large group has the qualities of the dependent group and is resistant to change whereas there is a much smaller reciprocal group that is so devoted to some new idea that it therefore has few converts. The two groups avoid coming together and thus development is prevented. "Society breeds copiously from its least cultural members while the 'best' people remain obdurately sterile (160)."

The pairing group is characterized by "the air of hopeful expectation (151)." The feelings are diametrically opposite to those of hatred, destruction and despair; but it is important that the leader, not necessarily a member of the group or even a person, but perhaps an idea or an object, remains unborn and the Messianic hope remains unrealized for the group to continue its existence. Once they are realized, the group is weakened and feelings of hope are gradually taken over by feelings of despair.

Some work groups develop sub-groups that provide the channel for the need for Messianic hope without disturbing the functionality of the work group.

The fight-flight group, of all the groups, exhibits a total absence of understanding as a technique for functioning and is driven almost exclusively by the feeling of hate.

Bion proposes that groups are driven by something even more fundamental than the basic assumptions and they are the primitive phantasies about the mother's body. There is a primal impulse to pair and the resultant anxiety makes individuals seek allies. "The more disturbed the group the more easily discernible are these primitive phantasies and mechanisms … the more stable the more it corresponds to Freud's description of the group as a repetition of family group patterns and neurotic mechanisms (165)."

It is possible to raise the mental life of a group to a higher mental plane such that the basic assumption groups do not get in the way of the work groups but that is done by acknowledging rather than ignoring the emotions that drive the basic assumption groups. While Bion's observations explain the strong resistance to change extracted by groups all around us, they also posit hope that the same understanding can provide room to devise ways in which change can be implemented meaningfully.

To Revive Or Not To Revive


For the longest time the Nepali Congress people have been blaming Baburam Bhattarai saying he is the one who dissolved the constituent assembly. In short, they have been missing the constituent assembly. Logic would say they would get excited about the idea of reviving the constituent assembly, to getting it back. That does not seem to be the case.

Reviving The Constituent Assembly For Good


Between the NC, the UML and the CPN(M) they have over 300 MPs in the constituent assembly. Reviving the constituent assembly for good - not just for a day, but for good, to complete all work on the constitution - might be a pretty good option. Those three parties will have the option to gang up and get rid of the Baburam Bhattarai government through due process, if that is what they might want.

Reviving The Constituent Assembly


There might not be a legal, constitutional option to revive the CA. But there might be a political option, a revolutionary option.

Is CA Revival Possible?

For the longest time in 2005 I argued there was no option to revive the parliament. But the parliament was revived in 2006. So maybe the politicians in Nepal know something I don't know. Perhaps the CA can be revived. If it can be, then that might be the best option.

Considering the Maoists have vertically split and the Baidya-Badal group has somewhere between 108 and 115 members in the last assembly, Baburam might be duly ousted as PM. It is curious to me though as to how Vaidya can support Koirala but not Baburam. Baburam is not left enough for Vaidya, but Sushil is?

The best part of reviving the CA is due process will come back on track. The CA can pass all election related ordinances. It can duly oust Bhattarai. The UCPN(M) and the Madhesi parties on their own do not have half the strength, do they?

So if all agreed upon issues can be codified, and all election related ordinances can be passed, and Baburam Bhattarai can be ousted through a no confidence motion, and a new government can be duly elected, and the country can move towards new elections then the option to revive the CA has to be looked at.

What if the CA is revived through political consensus and the Supreme Court declares it null and void? Then the CA will have the option to wash away the entire Supreme Court with two-third decision. Impeach all judges at once.

I am for reviving the CA, if that is an option. That is a no brainer. Of course it would be great to have the CA back. It is a duly elected body.

The parties have had a hard time agreeing on a consensus prime ministerial candidate. But they can perhaps agree to revive the CA. If they can come to that consensus they can say so to the president and perhaps the CA can be revived.

This feels like resurrection. It is a biblical concept.

In a revived CA Vaidya would be leading the third largest party, ahead of the UML.

As per the third option floated by the senior leaders, a new constitution should be promulgated from a revived Constituent Assembly (CA) by accommodating the issues that have already been resolved and then the new govenrment should be formed under the leadership of the opposition party...... According to the fourth option floated by the leaders, a national consensus government can be formed under the leadership of an independent person comprising political parties. ...... The meeting concluded that the CA must be revived even if political parties want to go for CA polls. "We should not go for polls by removing constitutional hurdles [through the president]," Singh said, adding, "Revival of the CA even for announcing new polls is the safest way."

Then UCPN (Maoist) leader Mohan Baidya split the party after it adopted "peace and constitution" as the party´s line against his demand for a "people´s revolt". .... around 100 representatives will participate from India, Europe, America and other parts of the Asia. A total of 44 central committee members and 30 central advisory committee members will participate in the general convention as organizing committee members. .... The party has completed conventions of the village, municipal and district levels. Bhusal informed that the state committee conventions will be completed by 1 January. .... Both UCPN (Maoist) and CPN-Maoist had announced their convention dates after the split. UCPN (Maoist) general convention scheduled for February 2, 2013 is overdue for two decades. Pushpa Kamal Dahal has been leading the party since the 1992 general convention held in Chitwan.

Bhattarai has already floated a proposal to nominate Dahal as the next prime ministerial candidate from the party if the NC and UML refuse to join the present government for a brief period..... But he will be termed anti-federalist if he proposes Koirala and will also be blamed for throwing out a government of his own party. The Bhattarai faction has been projecting Koirala as anti-federalist all along. ..... The president will only nominate a new prime minister in accordance with Article 38(1) of the Interim Constituent, i.e. at the recommendation of the political parties.
